This Service Agreement ("Agreement") is entered into between Osorio Group LLC, doing business as Occustat ("Occustat," "we," "us," or "our"), and the individual or entity purchasing services ("Client," "you," or "your"). By submitting the intake form and completing payment, you agree to be bound by the terms of this Agreement.
Occustat provides a private, custom-configured analytics dashboard for short-term rental operators using OwnerRez as their property management system. Services include:
To deliver the service, Occustat requires access to the Client's OwnerRez account data. The Client may choose one of two access methods:
Occustat will access the Client's OwnerRez account and data solely for the purpose of delivering the services described in this Agreement. We will not sell, share, or use Client data for any other purpose.
Occustat will make reasonable efforts to complete initial dashboard setup within 72 hours of receiving all required information and data from the Client. This timeline is an estimate, not a guarantee. The setup clock begins once all required access, data, and configuration information has been provided by the Client in full.
Dashboard figures including revenue, occupancy, ADR, and other metrics are calculated based on booking data provided by OwnerRez. Some figures may be estimates and may differ from reports generated directly in OwnerRez due to differences in calculation methodology, accrual treatment, or data timing. Occustat does not warrant that dashboard data will match OwnerRez reports exactly. Services are billed as follows:
All fees are charged in US dollars. Occustat uses Stripe for payment processing. By providing payment information, you authorize Occustat to charge the applicable fees on the schedule described above.
The Client may cancel their subscription at any time by contacting Occustat at [email protected]. Cancellation will take effect at the end of the current billing period. The Client will retain access to the dashboard through the end of the paid period. No partial-month refunds will be issued.
Occustat's dashboard is an analytical tool provided for informational purposes only. Occustat is not responsible for any business decisions made by the Client based on dashboard data. To the fullest extent permitted by applicable law, Occustat's total liability to the Client for any claim arising out of or related to this Agreement shall not exceed the total fees paid by the Client in the three months preceding the claim.
Occustat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or lost revenue, even if advised of the possibility of such damages.
In the course of delivering services, Occustat may use third-party tools to process, analyze, or store Client data. These tools are used solely for service delivery purposes. Occustat takes reasonable steps to ensure Client data is handled responsibly by any third-party tools used.
Occustat agrees to keep all Client data and account information confidential and will not disclose it to any third party except as required to deliver the services described in this Agreement or as required by law.
Occustat reserves the right to terminate service to any Client at any time for any reason, with at least 7 days written notice. In the event Occustat terminates service without cause, a prorated refund of any prepaid monthly fees will be issued.
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior discussions, representations, or agreements. Occustat reserves the right to update this Agreement at any time. Clients will be notified of material changes by email.
